1. Privacy Policy

1.1 Data Controller. NebulithTechnologies, located at Calle Joaquín Blume 23, Piso 6 B, Móstoles, Madrid, Spain, is the data controller responsible for the processing of personal data collected through our website and services.

1.2 Data We Collect. We collect personal data that you voluntarily provide when using our contact forms, registering for services, or communicating with us. This includes: your name, email address, phone number, billing information, IP address, browser type, and usage analytics.

1.3 Purpose of Processing. Your personal data is processed for the following purposes: to respond to your inquiries and provide requested services, to process payments and manage billing, to send service-related communications, to improve our website and user experience, and to comply with legal obligations under EU Regulation 2016/679 (GDPR).

1.4 Legal Basis. We process your data based on: your explicit consent (Article 6.1.a GDPR), performance of a contract (Article 6.1.b GDPR), and our legitimate interest in improving services (Article 6.1.f GDPR).

1.5 Data Retention. Personal data is retained only for as long as necessary to fulfill the purposes outlined in this policy, or as required by applicable Spanish and EU law. Contact form submissions are retained for a maximum of 12 months.

1.6 Your Rights. Under GDPR, you have the right to: access your personal data, rectify inaccurate data, request erasure ("right to be forgotten"), restrict processing, data portability, object to processing, and withdraw consent at any time. 1.7 International Transfers. We do not transfer your personal data outside the European Economic Area unless adequate safeguards are in place, such as Standard Contractual Clauses approved by the European Commission.

1.8 Data Security. NebulithTechnologies implements appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction, including encryption, access controls, and regular security audits.

2. Cookies Policy

2.1 What Are Cookies. Cookies are small text files stored on your device when you visit our website. They help us recognize your device and remember certain information about your visit.

2.2 Essential Cookies. Our website uses strictly necessary cookies required for basic site functionality, including session management and security tokens. These cookies do not require your consent under the EU ePrivacy Directive (2002/58/EC).

2.3 Analytics Cookies. We may use privacy-respecting analytics tools to understand how visitors interact with our website. This data is aggregated and does not identify individual users. IP addresses are anonymized before storage.

3. Refund Policy

3.1 Service Commitments. NebulithTechnologies delivers digital services including web development, registration system engineering, and event platform solutions. All project scopes are defined in written agreements prior to commencement.

3.2 Project Milestones. Payment schedules are tied to predefined project milestones. Each milestone payment becomes non-refundable upon approval and delivery of the corresponding deliverable. Milestone approvals are documented in writing.

3.3 Pre-Delivery Cancellation. If you cancel a project before any milestone has been delivered, you are entitled to a refund of any advance payments minus an administrative fee of 10% of the total project value, to cover planning and resource allocation costs.

3.4 Partial Refunds. If project cancellation occurs after partial delivery, refunds are calculated proportionally based on the undelivered portion of the agreed scope. Delivered and approved milestones are not eligible for refund.

3.5 Defective Deliverables. If a delivered milestone fails to meet the specifications defined in the project agreement, NebulithTechnologies will remediate the issue within 14 business days at no additional cost. If remediation is not possible, a proportional refund will be issued.

3.6 Refund Process. Refund requests must be submitted in writing to [email protected] within 30 days of the relevant milestone delivery. Refunds are processed within 14 business days of approval via the original payment method.

3.7 Non-Refundable Items. Domain registration fees, third-party license costs, and hosting setup fees are non-refundable once procured on behalf of the client.

4. Terms of Service

4.1 Acceptance. By accessing and using the services provided by NebulithTechnologies, located at Calle Joaquín Blume 23, Piso 6 B, Móstoles, Madrid, Spain, you agree to be bound by these Terms of Service. If you do not agree, you must not use our services.

4.2 Service Scope. NebulithTechnologies provides web development, event platform engineering, registration system design, and related digital services. All services are delivered based on written agreements that define scope, timelines, and deliverables.

4.3 Intellectual Property. Upon full payment, all custom-developed code, designs, and digital assets created specifically for a client project are transferred to the client. NebulithTechnologies retains the right to use generalized frameworks, tools, and methodologies developed during the engagement.

4.4 Client Responsibilities. The client is responsible for providing timely access to necessary accounts, content, and feedback. Delays in client-provided materials may affect project timelines. NebulithTechnologies will communicate revised schedules promptly.

4.5 Confidentiality. Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives termination of the agreement for a period of 24 months.

4.6 Limitation of Liability. NebulithTechnologies' total liability under any agreement shall not exceed the total fees paid by the client for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

4.7 Termination. Either party may terminate an agreement with 30 days written notice. Upon termination, the client is responsible for payment of all delivered and approved milestones. Undelivered work is cancelled without further obligation.

4.8 Governing Law. These Terms of Service are governed by the laws of Spain and the European Union. Any disputes shall be resolved in the competent courts of Móstoles, Madrid, Spain.

4.9 Amendments. NebulithTechnologies reserves the right to update these Terms of Service. Clients will be notified of material changes via email at least 15 days before they take effect.
